We think it is important for you to be informed of the policies, procedures, and security measures we have in place to safeguard your personal and confidential information. We have developed this policy to help you to understand the steps we take to protect your sensitive personal information. Privacy Updates

New product releases may require changes to our Privacy Policy. When such changes are made, we will indicate the date of the update at the top of the Privacy Policy. We will provide our customers copies of our Privacy Policy on an annual basis. If you have agreed to accept disclosures electronically, we may send you an email telling you where the Privacy Policy can be viewed from our website. 


Information That We Collect:

We collect nonpublic personal information about our customers from the following sources:

  • Information we receive from you on applications, emails, or other forms.

  • Information about your transactions with us and others.

  • Information we receive from a consumer-reporting agency.

  • Information that is generated when you contact us electronically.

Our Internet financial services provider, FundsXpress Financial Network, Inc. ("FundsXpress"), also collects and maintains certain information about our customers simply to help us provide banking and other financial services to you online. They may also collect certain information for security and statistical purposes. The information collected may include:

  • The internet address (referral site) which brought you to our web site.

  • The date and time you access our site. 

  • The name and version of your web browser.

  • Your Internet Protocol (IP) address.

  • Content of cookies sent by FundsXpress.

  • The pages visited in our website.

The information collected on the pages you visit is used only for statistical purposes and is tied only to your IP address.

Internet Protocol (IP) Addresses

An IP address is a number that's automatically assigned to your computer whenever you're surfing the Web. Web servers-the computers that "serve up" Web pages-automatically identify your computer by its IP address. 

FundsXpress does not link IP addresses to anything personally identifiable, which means that a user's session will be logged, but the user remains anonymous to us and FundsXpress.

FundsXpress may use IP addresses to audit the use of our site. FundsXpress can and will use IP addresses to identify a user when necessary for security purposes. 


Visitors to the Website 

Visitors to our website remain anonymous. We do not collect unique identifying information about you unless you voluntarily and knowingly provide us that information, and we don't send you a "cookie." 

FundsXpress does collect and disclose general information to us about your visit, such as when you accessed our site, which pages you accessed in our website, and what Internet provider you used when you accessed our site. 

You may elect to provide us with more specific information, such as when you give us feedback or send us an email. If you provide us this information, it is only used internally and in furtherance of the purpose for which it was provided. 

We do not disclose or sell to any third-party information that we collect or that is provided to us from visitors to our website. We do not send advertisements or email to someone who just visited our website. 


Use of Cookies

Internet Banking:
When you log on to our Internet banking system, our service provider, FundsXpress, passes a cookie to your browser. The cookie only identifies your computer. FundsXpress does not (and cannot) use cookies to collect or obtain new personal information about you.

This cookie allows FundsXpress to process multiple transactions during your session without requiring you to reenter your passcode for each individual transaction. The cookies for online banking simply provide another level of security for our Internet banking product.

The FundsXpress TM Internet banking product uses encrypted cookies that do not pass to your hard drive. Instead, the cookie is stored in the memory of your browser, identifying your computer while you are logged on. Only FundsXpress can read the information in these cookies. When you log off, close your browser, or turn off your machine, the cookie is destroyed. A new cookie is used for each session. That way, no one can use the prior cookie to access your account. For additional security, the cookie expires after 10 minutes of inactivity. It must then be renewed by reentering your passcode.


Information That We Disclose

  • We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as permitted by law. We do provide your account information to FundsXpress so that we may process your Internet Banking transactions.

  • We do not sell any of your personal information.

  • We will not disclose any medical information that you provide to us, unless you specifically authorize its disclosure.

Security 
This financial institution has developed strict policies and procedures to safeguard your personal information. We restrict employee access to your nonpublic personal information to a "need to know" basis. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information. We educate our employees about the importance of confidentiality and customer privacy. We take appropriate disciplinary measures to enforce employee privacy responsibilities. 
We offer secure email through our online banking services. You should use the secure mail service anytime you send us sensitive personal information.

Our Internet banking service provider, FundsXpress, has also developed security policies and procedures to protect the customer information that they must collect and maintain to help us process your banking transactions over the Internet. Children's Online Privacy Protection Rule (COPPA)

The COPPA and the Federal Trade Commission's implementing regulations (16 CFR 312) generally apply to financial institutions that operate commercial websites or online services (or portions thereof) that are directed to children, or that operate websites or onlines services and knowingly collect personal information from children under the age of 13. 

If your website site has special promotional accounts and/or services directed at children under 13, and/or you knowingly allow children under 13 to open on-line accounts, your privacy statement should include information on how you collect, use, and/or disclose personal information from children. 

In the children's area of your website, and each area you collect information from children, you must include a direct link to the applicable section of your privacy policy that's posted on your home page and/or portal. It should also be clearly disclosed at the top of your privacy policy that there is a specific section discussing your information sharing practices regarding children. 

You may also choose to post a separate privacy policy directed at children and include it in the area of your website that is specifically targeted to children.

With some exceptions, you must also obtain verifiable parental consent prior to any collection, use, and/or disclosure of personal information from children.

You must provide a reasonable means for a parent to review the personal information collected from a child and to refuse to permit its further use or maintenance.

You cannot condition a child's participation in a game, the offering of a prize, or another activity on the child disclosing more personal information than is reasonable necessary to participate in such activity.

And as with your other account information, you must establish and maintain reasonable procedures to protect the confidentiality, security, and integrity of personal information collected from children.

A sample clause for financial institutions that permit children under 13 to open online accounts is provided below:

Bank of Bluffs does not consider our Website to be directed at children less than 13 years old, but individuals within this age group could register for an online accounts. 

We want to help parents protect the privacy of children so when we identify applications or enrollment forms from a customer/member under the age of 13, we will send a Parental Consent Form to the physical address provided in the enrollment form. If the parent or guardian decides not to allow the online account or does not return the consent form within thirty days, we will decline acceptance of online banking accounts and services. 

This financial institution will not use information collected from customers/members under 13 years of age for any email advertisement, marketing or other promotional purposes, whatsoever. Information will only be shared with third parties as allowed by law. For further details on how we could use the information provided by your child, please read the section of our privacy policy that discusses Collection and Use of Information.

A parent or guardian has the right to review the personal information collected on a child under 13 years old. If requested, the parent or guardian can have the information deleted and refuse to allow any further collection or use of the child's information.
